Preamble
The present conditions cover the business relations between, on the one hand,
Louise Optic S.A, whose head office is located at 38 Avenue Louise 1050 Brussels, in Belgium, and is registered on the Brussels Trade Register under number 0859.582.029, and on the other hand,
any private individual replacing contact lenses or maintenance products via the website www.opticvision.be. This person will be referred to below as “the customer”.
The General Sales Conditions can be consulted online on the website www.opticvision.be, referred to below as “the website”. Louise Optic S.A reserves the right to amend these. Therefore, the applicable conditions are those in force on the date the order is placed.

1. Field of implementation
By validating his/her order on the website the customer acknowledges having read and accepted present conditions without reserve, and renounces to take advantage of his/hers. No dispensation of these General Conditions is allowed without prior written confirmation from Louise Optic S.A.
2. Information and advice
The website offers products from brands renowned for replacement contact lenses and their maintenance products. By placing an order the customer acknowledges being over 18. He/she also certifies having consulted an eye specialist and placed his/her order based exclusively on medical prescriptions less than a year old and drawn up by said specialist. The customer will confirm this at a stage prior to validating the order.
The customer declares being informed about the use and manipulation of contact lenses and their maintenance products. He/she pledges to scrupulously respect the basic rules of hygiene imposed by the manipulation specific to the insertion and removal of contact lenses. He/she assures that he/she fully masters the rules, manipulations and movements pertaining to the products sold on the website as the order concerns a replacement. The customer pledges to carefully read and respect the instructions for use provided with the delivered products. For any questions regarding specificity or use of the products bought on the website he/she will consult a recognized eye specialist. The customer pledges not to change type of contact lenses until conclusive trials have been carried out by said specialist.
3. Responsibilities regarding the offer of remote sales
Louise Optic S.A commercial mission, via the website www.opticvision.be, consists of offering replacement contact lenses and their maintenance products. It starts with the replacement order and ends with the delivery of the ordered products. Under no circumstances will Louise Optic S.A act as a specialist advisor on the products sold on the website. Louise Optic S.A cannot be held responsible for the quality of the products and their packaging. This responsibility lies with the manufacturer of the product bought. Also, any wrong use or manipulation of the product, or any adverse reaction to said product causing any type of damage or harm, either material or bodily, will in no way involve the responsibility of Louise Optic S.A. Louise Optic S.A reserves the right to amend the price of articles sold on the website; the retail price being the one indicated when the order is placed. Louise Optic S.A disclaims all responsibility in case the delivered product does not comply with the current legislation in the country where the delivery is made (outside Belgium).
4. Geographical range of the offer of remote sales
Louise Optic S.A sells remotely, from Belgium, to the entire Europe zone (EU), i.e.: Austria, Belgium, Cyprus, Finland, France, Germany, Greece, Ireland, Italy, Luxemburg, Malta, the Netherlands, Portugal, Slovakia, Slovenia, and Spain.
5. Price and payment
Prices indicated for each product are in Euro and are VAT inclusive. The applied tax rate is determined by the delivery address. The product’s retail price is the one indicated on the website when the order is placed. This price does not include processing and delivery costs. These costs are invoiced as supplements and are clearly indicated before final validation of the order. Any other costs inherent to placing an order, such as connection or communication costs will be borne by the customer. Payment of any order will be made online with a debit or credit card, and for the whole order. Online payment is made via secure “SSL PAYMENT”, a programme provided by Hipay which is approved by the Central Service for Information System Security, thus strictly complying with banking regulations. Hipay’s encryption process ensures complete confidentiality of the information provided by the customer. An order is only considered valid once payment has been accepted by the system chosen (Visa, Mastercard, CB, e-Carte Bleue or PayPal). The data recorded by the payment system will constitute proof of all transactions. Any fraudulent use of a method of payment will in no way involve the responsibility of Louise Optic S.A, who will initiate legal proceedings against the fraudulent user.
6. Order and contract implementation
The order can only be placed online, and solely via the website www.opticvision.be. The personal data and information provided by the customer when placing the order must be accurate. The click validating the order constitutes an irrevocable commitment on his/her part. Every order falls under the present General Conditions and only becomes contractual once an email has been sent, confirming the validation of the order by Louise Optic S.A, after acceptance of payment. The product illustrations on the website are not part of the contractual field. Any change of packing, packaging and/or display of the product in general will in no way involve the responsibility of Louise Optic S.A. Articles are offered subject to stock availability. In case of non-availability Louise Optic S.A will inform the customer by email. Louise Optic S.A cannot be held responsible should an event of force majeure occur, affecting production, availability, transport or delivery of the product.
7. Transfer of ownership
The transfer of ownership of the ordered product will take place as soon as the contract has been concluded, i.e. as soon as confirmation of the order’s validation has been sent, after acceptance of payment.
8. Delivery
The average delivery time is 7 working days, the maximum time being 30 days from the day after receipt of confirmation of the order’s validation, sent by Louise Optic S.A Under no circumstances can the customer claim compensation in case the delivery is delayed, neither from Louise Optic S.A, nor from the carrier. Delivery is considered completed as soon as the product has been delivered at the address indicated on the order. The customer must check that the delivered contents are in good condition. If products are missing and/or damaged, the customer should inform the carrier immediately in order to initiate the ad hoc procedure established by the carrier. The customer must notify Louise Optic S.A within 8 working days in case of visible defects, or if the product doesn’t correspond to the one ordered,

If the customer is repeatedly absent, thus preventing delivery at the address indicated on the order, and after delivery has been attempted a maximum number of times as stated in the carrier’s General Conditions, the order will be returned to Louise Optic S.A. The customer will be notified by email. The total cost of re-delivery will be borne by the customer.
9. Cancellation clause
In accordance with the law of 6 April 2010 on business practices and on consumer protection, the customer has the right to cancel his/her order without penalty or stating of reason, provided he/she gives notice within 14 working days from the day after receipt of the goods. The customer must notify his/her cancellation by registered mail with acknowledgement of receipt, sent to: Louise Optic S.A 38 Avenue Louise 1050 Brussels, Belgium. The right to cancel does not apply if products have been used or damaged. The customer should return the order in its original packaging and at his/her own expense. He/she has a maximum of 14 working days from the day after receipt of the goods to do so. This clause is available only for goods brought on the website www.opticvision.be

11. Privacy Policy and Data Protection
Louise Optic S.A complies with current Belgian legislation on privacy and data protection. Personal data supplied Louise Optic S.A when placing an order will not be disclosed to third parties unless the customer has given his/her express consent. The customer is entitled to ask for the personal data gathered by Louise Optic S.A to be corrected, amended or deleted. To do so the customer should contact Louise Optic S.A Customer Service, as stated under article 10.
12. Intellectual Property
All texts, illustrations and graphics appearing on the website are, together with their layout, protected by Intellectual Property Rights and may not be copied or put to any other use unless Louise Optic S.A has given its express consent.
13. General points
Nullity or inapplicability of one of the clauses in the present General Conditions does in no way affect the validity or applicability of the other clauses. If need be the parties pledge to replace the void or inapplicable clause by a valid one matching as closely as possible, from a business point of view, the clause implicated.
14. Applicable legislation and area of jurisdiction
Belgian law is the only law applicable in case of litigation and if no amicable agreement can be reached. Only the Law Courts of Brussels have legal competence, regardless of the place of delivery and/or residence of the customer.
